These terms form an integral part of the Passenger Consent Form of Midlife Holidays and are applicable in hilly, snowfall-prone, and adverse weather regions. By booking the tour and boarding the vehicle, passengers agree to the following conditions:
A. FORCE MAJEURE & SAFETY PRIORITY
- Snowfall, black ice, road blockage, landslides, avalanches, heavy rain, fog, vehicle restrictions by authorities, or sudden weather changes are natural and uncontrollable events.
- Passenger safety shall always be the top priority. Decisions taken by the driver, transporter, local administration, police, or Midlife Holidays for route change, stoppage, or trip suspension shall be final and binding.
- Such situations shall be treated as Force Majeure, and no liability shall arise on Midlife Holidays.
B. VEHICLE RESTRICTIONS & JOURNEY INTERRUPTION
- In case roads are closed or declared unsafe due to snow, black ice, or landslides, the tour vehicle may be stopped at the last safe point as per administration or driver’s judgment.
- Midlife Holidays shall not be responsible if the vehicle is not allowed to proceed further due to government orders, police instructions, or road conditions.
- In such situations, passengers may be required to:
- Walk short distances
- Arrange alternate local transport
- Reach the hotel or destination at their own responsibility and cost
C. HOTEL STAY & EXTRA ACCOMMODATION
- Hotel payments are made in advance as per the confirmed itinerary.
- If passengers are unable to reach the booked hotel due to road closure or weather conditions:
- Midlife Holidays shall not be responsible for arranging alternate accommodation
- Any additional hotel stay, emergency room booking, or extension shall be entirely at passenger’s own expense
- Passengers must directly coordinate and settle payments with the hotel they choose to stay at during such emergencies.
- No refund or adjustment shall be applicable for prepaid hotels already paid by Midlife Holidays.
D. 4×4 / SNOW VEHICLES / LOCAL TRANSPORT
- In snowfall or black ice conditions, normal vehicles may not be permitted or safe to operate.
- If passengers choose or are required to use 4×4 vehicles, snow jeeps, chains-fitted vehicles, ponies, porters, or any local transport:
- Such arrangements shall be made directly by passengers
- All costs shall be borne by passengers themselves
- Midlife Holidays shall not be responsible for availability, pricing, safety, delays, or service quality of such local arrangements.
E. MEALS & SERVICES DURING DISRUPTION
- In case of road blockage, delays, or journey interruption due to snow or landslides:
- Midlife Holidays shall not be responsible for providing breakfast, lunch, dinner, or any refreshments en route
- Any food expenses incurred during such delays shall be borne by passengers
- Missed meals or hotel inclusions due to force majeure situations shall not be refundable.
F. NO REFUND / NO CLAIM POLICY
- No refund, compensation, or claim shall be entertained for:
- Missed sightseeing
- Extra hotel stays
- Additional transport
- Meals or personal expenses
- Early return or delayed arrival
- Passengers agree not to initiate any legal claim, dispute, or chargeback against Midlife Holidays for losses arising due to snow, black ice, road closure, or landslides.
G. PASSENGER ACKNOWLEDGEMENT
- Passengers confirm that they are aware of the risks involved in hill travel during winter and adverse weather conditions.
- By signing the consent form, passengers fully accept these terms and agree to bear all additional costs arising from such situations.
Midlife Holidays reserves the right to modify routes, itineraries, or services in the interest of passenger safety.
This clause is legally binding and enforceable under Indian law.
