This clause forms an integral, mandatory, and binding part of the Passenger Consent Form of Midlife Holidays. By booking the tour, making payment, and/or boarding the vehicle, the passenger expressly agrees to the following legal conditions:
A. COMPANY ADDRESS & EXCLUSIVE JURISDICTION
- The registered / operational address of Midlife Holidays is located at Amroha, Uttar Pradesh.
- All disputes, claims, differences, complaints, or legal matters of any nature whatsoever arising out of or relating to:
- Tour booking or cancellation
- Travel, transport, or vehicle services
- Hotel accommodation
- Luggage, safety, delay, breakdown, or itinerary changes
- Any act, omission, or service provided by Midlife Holidays
shall be subject to the exclusive jurisdiction of courts situated at Amroha, Uttar Pradesh only.
- No court, forum, or authority outside Amroha, Uttar Pradesh shall have jurisdiction to entertain any matter against Midlife Holidays.
B. POLICE COMPLAINT / FIR JURISDICTION
- Any police complaint, FIR, legal notice, or criminal proceeding against Midlife Holidays, its proprietors, partners, employees, representatives, drivers, or associates shall be:
- Filed only at the local police station having jurisdiction over Amroha, Uttar Pradesh
- Any FIR, complaint, or proceeding initiated in any other city, district, or state shall be deemed improper, invalid, and non-binding on Midlife Holidays.
C. THIRD-PARTY DISPUTES (HOTEL / TRANSPORTER / LOCAL VENDORS)
- Any dispute involving hotels, transporters, drivers, local vehicle operators, activity providers, or other third parties shall be:
- Resolved directly between the passenger and the concerned service provider
- Subject to the jurisdiction applicable to that service provider
- Midlife Holidays shall not be compelled or impleaded as a party in such disputes outside the agreed jurisdiction of Amroha, Uttar Pradesh.
D. LEGAL COSTS & INDEMNITY
- If the passenger initiates or attempts to initiate any legal action, FIR, or complaint against Midlife Holidays outside Amroha, Uttar Pradesh:
- The passenger shall be solely responsible for all legal expenses, advocate fees, travel costs, losses, and damages incurred by Midlife Holidays
- The passenger agrees to indemnify and keep Midlife Holidays harmless against any misuse of legal process or jurisdiction.
E. BINDING EFFECT & ACCEPTANCE
- This jurisdiction clause shall remain valid and enforceable even after completion, cancellation, or termination of the tour.
- By signing the consent form, the passenger confirms that they have read, understood, and voluntarily accepted the exclusive jurisdiction of Amroha, Uttar Pradesh.
Midlife Holidays reserves all rights under applicable Indian laws.
This clause is legally binding and enforceable under Indian law.
