VEHICLE BREAKDOWN / MECHANICAL ISSUE / SIGHTSEEING CANCELLATION – TERMS & CONDITIONS

These terms form an integral part of the Passenger Consent Form of Midlife Holidays. By booking the tour and boarding the vehicle, passengers acknowledge and agree to the following conditions related to vehicle breakdowns and operational disruptions:


  1. All vehicles used during the tour are arranged through third-party transporters and are operated as per local transport rules and conditions.
  2. Despite proper maintenance, vehicles may face mechanical breakdowns, tyre punctures, electrical faults, accidents, or other technical issues which are beyond human control.
  3. Midlife Holidays shall not be held responsible for such unforeseen mechanical or operational failures.

  1. In case of vehicle breakdown or technical issue during the route:
    • The driver/transporter shall make reasonable efforts to repair or arrange an alternate vehicle, subject to availability
    • Repair or replacement time may vary depending on location, terrain, weather, and spare availability
  2. Passengers must cooperate and remain patient during such situations, especially in remote or hilly areas.
  3. Midlife Holidays shall not be responsible for delays caused due to breakdowns or repair time.

  1. If an alternate vehicle, local taxi, or emergency transport is required:
    • Arrangement shall be subject to local availability
    • Any additional cost shall be borne by the passengers directly
  2. Midlife Holidays is not obligated to upgrade vehicle category or provide immediate replacement in breakdown situations.

  1. Due to vehicle breakdown, delays, traffic, weather conditions, road restrictions, or administrative instructions, one or more sightseeing points may be:
    • Missed
    • Skipped
    • Shortened
    • Rescheduled
  2. Cancellation or alteration of sightseeing due to such reasons shall not be considered a breach of contract.
  3. No refund, adjustment, or compensation shall be applicable for any missed or cancelled sightseeing.

  1. Delayed arrival due to vehicle issues may result in:
  • Late hotel check-in
  • Missed meals or inclusions
  1. Midlife Holidays shall not be responsible for refund or compensation for such missed services.

  1. No refund, compensation, or legal claim shall be entertained for:
  • Vehicle breakdown or replacement delay
  • Missed sightseeing or activities
  • Extra expenses incurred by passengers
  • Mental stress, inconvenience, or loss of time
  1. Passengers agree not to initiate disputes, chargebacks, or legal proceedings against Midlife Holidays arising from such situations.

  1. Passengers confirm that they understand that vehicle travel, especially in long-distance and hilly routes, carries inherent risks of delay and disruption.
  2. By signing the consent form, passengers fully accept these terms and conditions.

Midlife Holidays reserves the right to modify routes, vehicles, or itineraries in the interest of safety and operational feasibility.

This clause is legally binding and enforceable under Indian law.
