This clause forms an integral and binding part of the Passenger Consent Form of Midlife Holidays. By booking the tour and/or boarding the vehicle, the passenger clearly understands and agrees to the following:
A. INSURANCE NOT INCLUDED
- No insurance of any kind is included in the tour package unless expressly mentioned in writing by Midlife Holidays.
- This includes but is not limited to:
- Travel insurance
- Medical or health insurance
- Accident or life insurance
- Baggage or personal belongings insurance
- Trip cancellation or delay insurance
B. PASSENGER’S SOLE RESPONSIBILITY
- It is the sole responsibility of the passenger to arrange adequate insurance coverage for:
- Medical treatment
- Accidents or injuries
- Hospitalization or emergency care
- Evacuation or ambulance services
- Death, disability, or personal loss
- Midlife Holidays does not arrange, recommend, verify, or manage insurance for any passenger.
C. HEALTH ISSUES / ACCIDENTS / MEDICAL EMERGENCIES
- In case of any health issue, illness, injury, accident, or medical emergency during the tour:
- Midlife Holidays shall not be responsible to provide medical help, assistance, or treatment
- Midlife Holidays shall not bear or reimburse any medical, hospital, ambulance, or medicine expenses
- All medical decisions, arrangements, and expenses shall be handled directly by the passenger or their family.
D. NO LIABILITY / NO CLAIM
- Passengers agree that no claim, compensation, or legal demand shall be raised against Midlife Holidays for any health-related issue, accident, injury, disability, or death.
- Any loss that could have been covered under insurance shall be the passenger’s own responsibility.
E. ACKNOWLEDGEMENT & ACCEPTANCE
- Passengers confirm that they are physically fit to travel and understand the risks involved in long-distance and hill travel.
- By signing the consent form, the passenger voluntarily accepts full responsibility for their health, safety, and insurance arrangements.
This clause is legally binding and enforceable under Indian law.
